Terms of Service & Conditions of International Sale

1. Acceptance of Terms & Eligibility

These Terms of Service and Conditions of International Sale (“Terms”) represent a legally binding agreement between you (“Customer”, “Buyer”, or “Grower”) and Asian 3S Co., Ltd. (“Asian 3S”, “we”, “us”). By accessing asian3s.app, submitting an order, registering an account, or purchasing our organic bio-fertilizers, soil conditioners, or crop protection products, you agree to be bound by these Terms.

You represent and warrant that you are at least eighteen (18) years of age or the age of majority in your jurisdiction of residence, and possess the full legal capacity to enter into binding contracts.

To preserve active microbial CFU/g count and ensure safe field application:

• Products must be stored in a cool, dry area between 15°C and 28°C (59°F–82°F) away from direct sunlight and extreme heat.
• Do not mix active biological inoculants simultaneously in the same tank with high-toxicity synthetic copper fungicides or systemic chemical bactericides, as they will neutralize beneficial biological organisms.
• Keep out of reach of children and domestic animals. While 100% biodegradable and non-toxic, products are intended exclusively for agricultural soil and foliar nutrition.

5. International Orders, Import Laws & Customs Responsibility

For orders destined outside the country of origin:

• Incoterms & Delivery Duty: Unless explicitly confirmed in writing as Delivered Duty Paid (DDP), international retail and commercial consignments are shipped Delivered at Place (DAP / DDU). The Buyer is the designated importer of record and is responsible for compliance with local agricultural import regulations and the payment of any applicable destination duties, VAT, or local inspection fees.
• Phytosanitary Certificates: We provide laboratory Certificates of Analysis (CoA) and official Phytosanitary Certificates issued by authorized national plant quarantine authorities for all qualifying international bulk orders.
• Customs Seizures: If a shipment is detained or refused entry due to local regulatory changes in the destination country that were not pre-cleared by the importer, Asian 3S will provide documentation to assist release, but cannot be held liable for storage charges or customs destruction orders.

6. Payment Terms, Currencies & Chargeback Policy

All prices are stated in US Dollars (USD) or displayed in local currency equivalents based on prevailing international exchange rates. We accept Visa, Mastercard, PayPal, UnionPay, JCB, Debit, and Bakong KHQR.

Dispute Resolution Before Chargeback: In the event of a billing discrepancy or shipping delay, the Buyer agrees to notify Asian 3S customer support (support@asian3s.com) and grant a minimum of fourteen (14) business days to investigate and resolve the issue before initiating an external bank chargeback or dispute. Fraudulent chargebacks will be subject to collection proceedings and recovery fees.

7. Dispute Resolution & Mandatory Binding Arbitration

Informal Negotiation: In the event of any controversy, claim, or dispute arising out of or relating to these Terms or the purchase of products, the parties agree to engage in informal good-faith negotiations for at least thirty (30) days following written notice.

Binding Arbitration: If the dispute is not resolved informally, it shall be finally settled under the Rules of Arbitration of the Singapore International Arbitration Centre (SIAC) or by an internationally recognized arbitration tribunal. The arbitration shall take place in the English language before a single independent arbitrator.

Class Action Waiver: TO THE EXTENT PERMITTED BY LAW IN THE UNITED STATES AND ELSEWHERE, THE BUYER AND ASIAN 3S AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
